RENTAL AGREEMENT

RENTAL AGREEMENT, LIABILITY WAIVER, AND FEE SCHEDULE.

These are the terms that apply to every Ten Totes rental. Renting totes, equipment, or supplies from us means you accept them.

01Parties and agreement

This agreement is between Ten Totes ("we," "us") and the person or company renting equipment ("you"). Placing an order, signing a delivery receipt, or accepting delivery of any tote or equipment forms a binding rental agreement on these terms. If you rent on behalf of a company, you confirm you are authorized to do so.

02Ownership of equipment

All totes, lids, dollies, hand trucks, straps, blankets, floor protection, and other items remain the exclusive property of Ten Totes at all times. Renting gives you temporary use only. You may not sell, sublease, loan, alter, paint, drill, or permanently mark any item, and you may not remove or deface the permanent QR label on a tote.

03Rental period, extensions, and returns

Your rental period starts on the delivery date and ends on the scheduled pickup date. Extensions must be requested before pickup and are subject to availability at the weekly extension rate for your tote tier. A 24-hour grace period applies before late charges begin. Equipment must be empty, closed, stacked, and accessible at the agreed pickup location during the scheduled window.

04Delivery, access, and inspection

You are responsible for providing safe, legal access including parking, gate or building codes, elevator reservations, and a clear path. Inspect all equipment on arrival and report shortages or damage to us within 24 hours of delivery. After that window, equipment is considered received in good condition and the counts on your delivery record are final.

05Your responsibility for use and packing

You pack, lift, load, stack, transport, and unpack all totes. Ten Totes does not provide moving labor and does not pack, handle, or transport your belongings. Do not exceed the recommended weight per tote or safe stack heights, do not stand or sit on totes, and do not use equipment outdoors in unsafe conditions or on unstable surfaces.

06Contents are yours alone

We never inspect, inventory, photograph, insure, or take custody of what you place inside a tote. You are solely responsible for the value, condition, and legality of your contents. Ten Totes is not liable for loss, theft, breakage, water damage, scratching, or any other damage to items placed in or moved with our equipment, including fragile, sentimental, or irreplaceable items.

07Prohibited items

The following may never be placed in our equipment. Prohibited use voids this rental, allows immediate recovery of equipment, and makes you responsible for cleaning, disposal, replacement, and any fines or claims that result.

  • Flammable or combustible liquids and fuels
  • Compressed gas cylinders and propane
  • Corrosive, toxic, or industrial chemicals
  • Paint, solvents, and pool chemicals
  • Ammunition, explosives, and fireworks
  • Illegal substances or stolen property
  • Perishable food, liquids, soil, or plants
  • Live animals, pests, or biohazardous material
  • Wet, moldy, or contaminated items
  • Cash, jewelry, or irreplaceable valuables

08Release of liability and assumption of risk

Moving involves physical risk. To the fullest extent allowed by law, you assume that risk and release Ten Totes, its owners, employees, and contractors from all claims for personal injury, property damage, damage to floors, walls, doorways, elevators, vehicles, or premises, and any other loss arising from your use, loading, transport, or storage of rented equipment, except where caused by our own gross negligence or willful misconduct.

09Limitation of liability and indemnity

Our total liability for any claim connected to a rental is limited to the amount you paid for that rental. We are not liable for indirect, incidental, special, or consequential damages, including lost time, delayed moves, missed closings, or lost profits. You agree to indemnify and hold Ten Totes harmless from third-party claims arising from your use of the equipment, including claims by movers, helpers, landlords, or property owners.

10Damage, loss, and replacement charges

Normal wear such as light scuffing and surface dust is expected and never charged. Missing, cracked, burned, contaminated, or structurally damaged equipment is charged at the published replacement rates below. Equipment not returned after the grace period and reasonable notice is treated as lost and billed at replacement value.

11Payment authorization and collection

You authorize us to charge the payment method on file for the rental, approved extensions, add-ons, applicable taxes, and any incidental, cleaning, trip, or replacement charges described here. Unpaid balances may be referred for collection, and you are responsible for reasonable collection and legal costs allowed by law.

12Cancellation and rescheduling

Cancel or reschedule free of charge up to 24 hours before your delivery window. Inside 24 hours, a late cancellation fee applies. If our crew arrives and cannot deliver or pick up because of access, scheduling, or unprepared equipment, a trip fee applies.

13QR labels and privacy

Each tote carries a permanent QR label linked only to a short text label you choose to type, such as Kitchen or Fragile. We do not store photos, item lists, or your personal information on that label, and anyone with physical access to the tote can read or change it, exactly like writing on cardboard. Do not type sensitive information into a label.

14Right to recover equipment

If equipment is not returned, payment fails, or prohibited use occurs, we may suspend service, stop future rentals, and recover our equipment from the delivery or pickup location using any lawful means. Failing to return rental property may also carry consequences under Nevada law.

15Governing law and disputes

This agreement is governed by the laws of the State of Nevada, without regard to conflict of law rules. Any dispute is brought exclusively in the state or federal courts located in Washoe County, Nevada. If any provision is found unenforceable, the rest stays in full effect.
